1. OPERATING CONDITIONS:

The following terms and conditions apply to the “outlet” sale of the products of the Jané, Concord and Be Cool brands, or any others that may be determined in the future, presented on this website by the company GROUP JANÉ OUTLET, S.L., with registered address at Palau Solità, Pol.Ind.Riera de Caldes Cl.Mercaders s/n, listed on the Commercial Register of Barcelona in Volume 35931, Sheet 210, page B-271601 and with Tax Code B-63 237 341 (hereinafter, “GROUPJANEOUTLET.COM”), to the customer or user (hereinafter, the Customer or USER) as well as the use thereof. Browsing the online shop, or purchasing any of the products offered, implies that the user accepts each and every one of these general terms and conditions of contract and use with no reservations. Notwithstanding this, if you have any queries, please, contact our Customer Services department.

GROUPJANEOUTLET.COM gives the user the opportunity to purchase products that are ONLY from stock from other seasons, samples and surplus items from collections in a controlled manner applying to the Jané, Concord and Be Cool brands. None of the products offered have any defects or faults. All the products offered via the GROUPJANEOUTLET.COM have the corresponding guarantee as required by the regulations in force. GROUPJANEOUTLET.COM hereby states that the price policy does not interfere IN ANY WAY with the traditional sales channel. The prices shown on GROUPJANEOUTLET.COM are the final amount to be paid by the user minus the delivery charges (See the Price Policy). We are unable to publish the reference RRP as these are collections from previous seasons and because GROUPJANEOUTLET.COM does not have an official approved RRP.

GROUPJANEOUTLET.COM may, at any time and with no prior notice, amend these general terms and conditions of contract and use, as well as the specific conditions which, as applicable, may be included, by means of publishing such amendments on the online shop for users to see, along with the date the amendments come into effect, always observing the legislation and regulations in force. The products shown on this website, and more specifically the prices, characteristics, offers and any other type of information, may vary with no prior notice. In all cases, before using the services, you may consult the General Terms and Conditions in force.

These General Terms and Conditions are subject to the provisions of Law 7/1996, of 15 January, on Retail Commerce Regulations, Law 7/1998, of 13 April, on General Terms and Conditions of Contract, Royal Legislative Decree 1/2007, of 16 November, consolidating into a single text Law 26/1984, of 19 July, on the General Terms and Conditions for the Protection of Consumers and Users and the transposition regulations for the established EU directives on Consumer Protection, Organic Law 15/1999, of 13 December, on Personal Data Protection and its implementing regulation, and Law 34/2002 of 11 July, on “LSSI” (Information Society Services and Electronic Commerce).
GROUPJANEOUTLET.COM does not guarantee that the products will remain permanently available, and is exonerated of any type of liability for any possible damages and loss caused by the unavailability of a product due to issues of force majeure or errors in the data transfer telematic networks, that are beyond its control. GROUPJANEOUTLET.COM is not responsible for the contents of links to other webpages that it does not own and which, therefore, it has no control over.


2. OWNERSHIP OF THE CONTENTS OF THE WEBSITE.
 
All the contents published on the online shop and, in particular, the designs, illustrations, texts, graphics, photographs, images, logos, icons, buttons, as well as the software, trade names, brands or industrial drawings and any other signs that may be put to industrial and commercial use are subject to intellectual and industrial property rights belonging to GROUPJANEOUTLET.COM and are the exclusive property of GROUPJANEOUTLET.COM. Under no circumstances will it be understood that any licence has been issued, or any waiver, transmission, or total or partial assignment concerning these rights has been granted, and no rights or expectation of rights will be granted regarding the alteration, usage, reproduction, distribution or public broadcast of these contents without prior explicit authorisation from GROUPJANEOUTLET.COM.
 
GROUPJANEOUTLET.COM is not responsible, under any circumstances and in any way, for any infringements committed by the USER.

The articles offered on this website are products of GROUPJANEOUTLET.COM and they comply with the same quality and guarantee requisites as the products on sale in retail establishments.

GROUPJANEOUTLET.COM has tried to show the colours of the products as realistically as possible. However, the colour of the products displayed on the screen may be subject to variations depending on the quality of your computer monitor. Therefore, GROUPJANEOUTLET.COM cannot guarantee that the colours shown on your monitor are identical to the colour of the products.


Any special offers, promotions or discounts will be valid until the date indicated and only while stocks last.

Customers of GROUPJANEOUTLET.COM will be entitled to the product guarantee from the dispatch date pursuant to the regulations in force. Any defects or faults due to incorrect use or handling of the material or wear and tear that occurs with normal use, are not included in this guarantee. Any loss of functionality of the articles, due to the limitations of the product design, are also excluded from the coverage of this guarantee.

Under no circumstances does the guarantee cover any wear and tear or other results of the normal ageing of the articles or damages caused by misuse.


The customer is, at all times, EXCLUSIVELY responsible for the correct use and functioning of the products offered at GROUPJANEOUTLET.COM. GROUPJANEOUTLET.COM is not responsible for any misuse of its products and the consequences that may ensue.

6. PURCHASE PROCEDURE

In order to place an order, you can choose to make your purchase as a registered user, by completing the electronic form that will be displayed on the website and following the instructions given. After registering, and in order to proceed with your purchase, you should add the product you wish to buy to your basket, following the instructions shown on the screen, completing the order form displayed and confirming it. By confirming the order, the customer states that they have read and accept these general terms and conditions of contract as part of the execution of the contract.
 
6.1 Order

The articles you wish to purchase should be selected and added to your shopping basket by clicking on the corresponding symbol. The shopping basket will contain the reference of the selected article, its name and the price in euros (with the approximate value in your currency, although this will not be the trade value). The corresponding taxes will be listed separately and the delivery charges will also be shown which will vary depending on the destination country.

If we do not have an article in stock, we will advise you of this when you add the article to your shopping basket, so you can decide whether you want to wait a maximum of 15 days for the product to be dispatched, or if you prefer to remove the item from your basket. If you decide to add the article to your basket, GROUPJANEOUTLET.COM will not charge you for the full amount of the order until the item in question is available, because we do not make partial deliveries of orders.

The order form will ask for your personal details which will be incorporated into our database so that GROUPJANEOUTLET.COM may process your order and to make it easier for you to place future orders on GROUPJANEOUTLET.COM. You may access your personal data and track all your orders. Remember that your personal details should be provided correctly to avoid any confusion or errors when it comes to dispatching your purchased item(s). And, if you so wish, you will receive mail and/or emails giving you information and publications relating to GROUPJANEOUTLET.COM.

Once you have completed the purchase order, and before the order is dispatched, an order summary will be displayed showing the purchased article, the total price (delivery charges and taxes included) and the delivery details. You will then need to confirm the order by clicking on the “Confirm Order” button.
 
6.2 Pricing Policy and Currency
 
All the prices shown by GROUPJANEOUTLET.COM on the online shop include the indirect taxes (Value Added Tax), provided that on the initial set-up page you have selected a destination country in the European Union.
 
With regards the Value Added Tax, as a general rule the tax rate in force in Spain will be applied, for territories within the European Union, where this tax is applicable. Any companies belonging to the European Union will be exempt from paying this tax, except for companies in Spain.
 
GROUPJANEOUTLET.COM, S.L. presents and sells the products in EUROS. However, the USER will be shown the approximate price in their local currency, although this will not be the trade value.

The prices displayed on GROUPJANEOUTLET.COM may be reviewed and amended if the conditions so require at any time.

6.3 Method of Payment
 
The only payment methods possible on the websites of GROUPJANEOUTLET.COM will be via credit card or PAYPAL. GROUPJANEOUTLET.COM guarantees that each transaction made via its website is 100% secure. All the operations that involve the transmission of personal or banking data are made using a secure environment. GROUPJANEOUTLET.COM uses a server that is based on the SSL standard security technology (Secure Sockets Layer). All the information you send us is sent encrypted via the internet.

Furthermore, the details of your credit card will not be registered on any database, instead they will be sent directly to the Bank’s POS (Point of Sale) terminal or to PAYPAL.
The POS terminal used by GROUPJANEOUTLET.COM is managed by the Spanish banking institution called 'CAIXABANK'. We can also confirm that in order to provide credit card holders with even greater security, the secure payment system called SET (Secure Electronic Transaction) has been added to the payment gateway of GROUPJANEOUTLET.COM. This means that the holder of a "secure" card may always make payments with a VISA card or MASTERCARD on GROUPJANEOUTLET.COM. If your card is not included in this payment system you will be unable to make any purchases or place orders.

In both cases, when paying with a VISA card or MASTERCARD, you will always be asked for the following information: the card number, the expiry date, and the Card Security Code that is the last 3 digits printed in italics on the back of your VISA card or MASTERCARD. This system provides greater security guarantees for the transaction. This process or procedure may change with no prior notice.

Payment with Secure Electronic Transaction is a system to guarantee transactions made over the Internet. The main purpose is to give greater security to the Internet user as well as to traders selling over the Internet as it certifies the buyer as the legitimate holder of the card being used. In practice, when paying with a “secure” VISA card or MASTERCARD, along with the number and expiry date, you will also be asked for a personal code to be used exclusively for Internet purchases that identifies you, unequivocally, as the card holder. This means that nobody can use your card to buy things over the Internet if they do not know this code. Credit card fraud is a crime, and GROUPJANEOUTLET.COM, will ALWAYS take legal and/or judicial action against anyone who makes a fraudulent transaction through the GROUPJANEOUTLET.COM shop.
 
6.4 Shipment of orders. Delivery charges.
 
GROUPJANEOUTLET.COM reserves the right to change the delivery method and the delivery company regardless of the information given on the website provided that this does not cause any clear inconvenience for the customer.

Deliveries to Spain: Mainland, Balearics, Canary Islands and Ceuta and Melilla.

The following terms and conditions will apply:

If the amount of the order is less than 100 euros the delivery charge is 7.20 euros
If the amount of the order is over 100 euros the delivery is free
The home delivery service uses fast-track courier services who will deliver the goods within a period of between 48 and 72 hours for deliveries to the Mainland, and between 3 and 5 working days for deliveries to the Balearics, Canary Islands, Ceuta and Melilla. This period starts from the date the order is collected by the courier from the GROUPJANEOUTLET.COM warehouse.


For the Canary Islands, Balearics, Ceuta and Melilla, the following terms and conditions will apply:

The customs system will apply the corresponding tax fees. We are unable to specify the amount of taxes the customer will have to pay when they receive their order because, for the Canary Islands for example, this will depend on the "I.G.C" (VAT of the Canary Islands) and "Canary Islands Customs". As a GUIDELINE, which is in no way definitive, they usually charge between 15 and 30 EUROS for Import Duties and Customs Administrative Papers, as well as the corresponding percentage of Canarian I.G.I.C. (Tax of the Canary Islands). GROUPJANEOUTLET.COM is not responsible for any possible variations that the customs service may make with no prior notice.)

Deliveries to other destinations: The following terms and conditions will apply:

Credit cards will ALWAYS be charged in EUROS. The customer accepts all the possible variations in rates (in favour of the customer or GROUPJANEOUTLET.COM) that may apply to the EXCHANGE RATE when the amount is debited from the customer’s account.

The countries we deliver to are: Germany, Austria, Belgium, Bulgaria, Denmark, Slovakia, Slovenia, Spain, Estonia, France, Greece, Hungary, Italy, Netherlands,  Portugal, Poland, United Kingdom, Czech Republic, and Sweden.

The delivery time is approximately 4 to 6 working days.

Important note: The prices stated for the delivery charges do not include any possible extra charges applied for customs and taxes which will be paid at the destination by the recipient of the goods. *Working days for GROUPJANEOUTLET.COM are Monday to Friday every week except for any days declared official public holidays in Spain, Cataluña and the premises of GROUPJANEOUTLET.COM in Palau de Plegamans (Barcelona, Spain).

7. RIGHT TO WITHDRAW
 
You have the right to withdraw from this contract within the period of 14 calendar days without the need for any justification.

The period for withdrawal will expire after 14 calendar days from the date on which you, or a third party on your behalf, other than the courier, received the goods.

To exercise your right to withdraw, you should notify us at GROUPJANEOUTLET.COM, with registered address at [   ], telephone number 937 03 18 00, e-mail info@groupjaneoutlet.com , informing us of your decision to withdraw from the contract by issuing us with an unequivocal statement (for example, a letter sent by post, fax or email). You may use the sample of a withdrawal form shown below, although this is not compulsory.

In order to be within the withdrawal time period, you only need to send us the notification that you are going to exercise your right to withdraw before the corresponding time period has elapsed.

Consequences of withdrawing from the contract

If you withdraw from the contract, we will refund all the payments we have received from you, including the delivery charges (except for any additional charges that may have been applied if you selected a delivery method that was more expensive than the cheapest ordinary delivery service we offer) with no undue delay and, in all cases, within 14 calendar days from the date on which we were notified of your decision to withdraw. We will then proceed to reimburse you using the same method of payment that you used for the original transaction, unless you have specifically instructed otherwise; you will not be charged any costs for the refund. We may retain the refund until we have received the goods, or until you have sent us a proof of return for the goods, whichever occurs first.

The right to withdraw from the contract does not apply to the following types of orders:

a) Orders for goods made following the customer’s or user’s specifications or goods that are clearly personalised.

b) Orders for goods that can deteriorate or expire quickly.

c) Orders for sealed goods that cannot be returned for health or hygiene reasons and when the seal has been broken after delivery.

You should return or deliver the goods directly to GROUPJANEOUTLET.COM, with registered address at [   ], telephone number 937 03 18 00, e-mail info@groupjaneoutlet.com, with no undue delay and, in all cases, within 14 calendar days from the date on which you informed us of your decision to withdraw from the contract. This condition will be accepted as fulfilled if the goods are returned before this period has expired. You are responsible for the cost of returning the goods.

You will only be responsible for a reduction in the value of the goods if they have been handled in a way that is unsuitable for the nature, characteristics and functioning of the goods.

8. EXCHANGES AND RETURNS

How to return goods

Proposal:

From your account, enter the “Order status” section. Print the order delivery note found in your confirmation email or in the “My Orders” section of “My Account” and include a copy of it inside the box that we will collect. “Contact us” and we will collect your parcel in the place and on the date you choose. The time may vary, as this depends on our logistics operator.

Once we have checked the returned goods at our warehouses, we will proceed to reimburse you with the corresponding amount. The refund will be made using the same method of payment you used for the order. You will be able to see it within a maximum of 5 working days. If you have paid delivery charges, these will not be refunded.

The product must be in the same condition as when you received it, with the original packaging and label and in the same box or a similar one. When we receive your parcel at our warehouse we will inspect the items and then process your refund.

Delivery charges paid when the order was placed will not be refunded.
The collection charges will be paid by GROUPJANEOUTLET.COM.
If the purchase was made using a promotional code you will be refunded the proportionate part of the total amount paid after having redeemed the voucher.
We do not admit exchanges. If you want to exchange your product you will have to request that it be collected and then purchase the required product.

9. MISCELLANEOUS

GROUPJANEOUTLET.COM will not use this medium to publish misleading advertising. With regards this point, misleading advertising will not be deemed to include any formal or numerical errors that may be found in the contents of the different sections of the online shop, caused by incomplete or faulty maintenance and/or updating of the information contained in these sections. As a result of the provisions of this paragraph, GROUPJANEOUTLET.COM, is obliged to correct any such errors as soon as it is made aware of them.
The users who contract goods or services via the online shop must be of legal age. Any contracting carried out by minors requires prior authorisation from their parents, guardians or legal representatives, who will be considered responsible for the contracting carried out by minors in their care. The minors themselves will be responsible for obtaining the necessary consent before proceeding to contract goods or services.

All notifications, requirements, requests and other communication that is necessary between the parties relating to these General Terms and Conditions, must be made in writing and must be sent observing the terms and conditions included in these General Terms and Conditions.


10. Applicable law and jurisdiction

These purchase terms and conditions are subject to Spanish legislation therefore the sales transactions will be understood to be completed at the registered address of GROUPJANEOUTLET.COM.

In order to resolve any dispute that may arise from this contract or legal act, the parties may appeal to the Consumer Arbitration Board of Cataluña, who will appoint an arbitrator or arbitrators and will manage the arbitration procedure. If none of the systems above prove effective, both parties will adhere to the Courts of the city of Barcelona and hereby waive their right to any other jurisdiction that may correspond to them. For disputes involving end consumers residing in Spain, the courts used will be those of the consumers’ place of residence.
